By using the website, you agree and acknowledge that the website may update, change or amend the Terms and Conditions and Customer Care Policy and/or other information provided on the website at any time without advance notice. Changed terms and conditions will become effective once posted on the website, and will not have any retrospective effect on existing contractual arrangements made through the website. You should read these terms and conditions every time you visit the website to ensure that you are aware of all the relevant terms and conditions. Subject to applicable law, under no circumstance is SafarPoint and/or its Licensors and/or Suppliers and/or its Service Providers responsible for any direct or indirect, incidental, special, punitive, exemplary or consequential damages of any kind (including but not limited to lost profits, lost savings or revenue, or loss or corruption of data or information) which arises out of or is in any way connected with your use of or inability to use the website whether based on breach of contract, tort, negligence, product liability or otherwise, even if advised of the possibility of such damages. This includes any information, products or services obtained through or any contract entered into via the website, but excludes carriage by air performed by airlines in respect of any ticket obtained using the booking engine provided on the website, which is subject to the conditions of carriage and applicable international conventions.

Acceptable Use

When using the website you declare and agree:
•    To use it solely to determine the availability of products and services offered on the website and to assist you to make legitimate reservations or transact business with us. You agree to use the website only for personal, non-commercial use.
•    To use the website services to make only legitimate reservations.
•    You are at least 18 years of age and you possess the legal authority to create a binding legal obligation.
•    You will inform such other persons about the Terms of Use that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto;
•    Not to make any false reservation or any reservation in anticipation of demand. The website may cancel, without notice, all confirmations associated with multiple reservations to one or more destination on or about the same date.
•    Not to deface, alter or interfere with the front end "look and feel" of the website or the underlying software code.
•    Not to take any action that may impose an unreasonable or disproportionately large load on the website or related infrastructure.
•    To all of our terms and conditions of purchase, including, but not limited to, full and timely payment of all amounts due and compliance with all rules concerning availability of prices, products, or services. All fees, assessments, charges, taxes and duties arising out of use of the website are your sole responsibility.
•    Not to do anything which will or might damage, interfere with, disrupt access to, interrupt or impair the functionality of the material available on the website, nor to upload any material that contains any computer viruses or other codes, files or programs designed to interrupt, destroy or limit the functionality of any software or equipment.
•    Not to post, distribute or otherwise upload any defamatory, libellous, offensive, infringing, obscene, indecent, harmful, threatening, abusive, tortuous, racially or ethnically objectionable or otherwise unlawful material or information or send any chain letters, junk mail, 'spamming' material or any other form of bulk communication.
•    Not to threaten, harass, stalk, abuse, disrupt or otherwise violate the rights of others, including individual privacy rights.

•    Also, not to do anything that is otherwise unlawful or which may create any liability on the part of the website.
•    Violate this Agreement or any applicable legislation in any other manner.
•    Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy and publicity) unless the User owns or controls the rights thereto or has received all consents thereof as may be required by law.
•    Upload or attach files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of another computer.
•    Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded.
•    Falsify the origin or source of software or other material contained in a file that is uploaded.
•    Advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters, or download any file posted by another user of a forum that the User knows, or reasonably should know, cannot be legally distributed in such manner.
•    Use this website or its contents for any commercial purpose;
•    Access, monitor or copy any content or information of this website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
•    Violate the restrictions in any robot exclusion headers on this website or bypass or circumvent other measures employed to prevent or limit access to this website;
•    Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
•    Deep-link to any portion of this website (including, without limitation, the purchase path for any travel services) for any purpose without our express written permission; or
•    ‘Frame’, ‘mirror’ or otherwise incorporate any part of this website into any other website without our prior written authorisation.
•    Not to host, display, upload, modify, publish, transmit, update or share the following:
o    Information belonging to another person for which the user does not have any right.
o    Information that is hateful, grossly harmful including harmful to minors, paedophilia, invasive of others’ privacy, racially, ethnically objectionable, disparaging, encouraging money laundering or gambling.
o    Information that infringes any Patent, Trademark, Copyright or other Proprietary rights.
o    Information that deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature.
o    Information that threatens the unity, integrity, defence, security or sovereignty of the countries we operate in, friendly relations with foreign states or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or insults any other nation.
o    Information that impersonates another person.
If the website considers that you have breached any of these terms and conditions or have otherwise demonstrated inappropriate conduct when using the website, SafarPoint reserves the right to:
•    Warn you that you have breached these terms and conditions, and ask you to stop such conduct;
•    Delete any material or content which you may have posted without notice to you;
•    Take measures (including terminating, suspending or restricting your access) to, and preventing you from using the website;
•    Cancel any bookings and/or reservations that you may have with SafarPoint without reference to you;
•    Report your activities to an internet service provider or relevant authorities;
•    Take legal action against you.

Fraud Management

If your booking or account shows signs of fraud, abuse, or suspicious activity, the website may cancel any travel or service reservations associated with your name, email address, or account, and close any associated SafarPoint accounts. If you have conducted any fraudulent activity, the website reserves the right to take any necessary Criminal and/or Civil legal action and you may be liable for monetary losses to the website, including litigation costs and damages. To contest the cancellation of a booking or freezing or closure of an account, please contact SafarPoint Customer Care.
The website reserves the right to undertake all necessary steps to ensure that the security, safety and integrity of SafarPoint’s systems, as well as its clients’ interests, are and remain, well-protected. Towards this end, SafarPoint may take various steps to verify and confirm the authenticity, enforceability and validity of bookings placed by you.
If SafarPoint , in its sole and exclusive discretion, concludes that the said transactions are not or do not reasonably appear to be authentic, enforceable or valid, then SafarPoint may cancel the said bookings at any time before the scheduled time of departure of the relevant flight or before the expected date of visit to any property booked through SafarPoint .
In the event that a refundable booking is made and subsequently cancelled, SafarPoint reserves the right to impose a processing fee if the cancellation is determined to be abusive in nature. The processing fee will be 5% of the booking value and will be deducted from any refund due to the customer. Please note that the SafarPoint 's determination of what constitutes abusive cancellation behavior is at its sole discretion.

Terms of use for bank payment and credit cards and taxes

Payment is accepted via credit cards issued from various countries. However, some credit cards issued from specific countries may be restricted from use on our website and are not allowed during the booking process.

Payment is also accepted via open-loop debit cards issued by banks for use in e-commerce websites. If your debit card does not work on the website, please contact the card issuer to activate it. The bank may replace your old debit card with a new one that allows you to use it on e-commerce websites.

The payment will be deducted from your credit card or debit card upon completing the booking process.

Currency conversion: The price will be calculated based on the website or app's country address and the currency you choose for that country.

The primary currency for payment on safar-point.com is the Saudi Riyal.

Any price displayed in a currency other than the local currency is for display purposes only, and the amount will be deducted according to the local currency. If payment is made using a credit card from a foreign bank, additional fees may apply, according to the policy of the bank you are dealing with.

The ticket will be sent to your registered email address during the payment process.

Notice: Safar Point does not assume any responsibility and is not liable for any loss, damage, loss, or unauthorized access associated with credit card or debit card data. Safar Point is not responsible for your decision to use credit card or debit card information on this website, despite being informed by Safar Point about the possibility of these damages.

We will make every effort to maintain confidentiality when you make online payments. This includes the confidentiality of credit card information and personal information. All your personal information will be encrypted when booking your trip online.

Payment is accepted using most credit cards or debit cards. You can also include other travelers in the booking process through our website.

You can pay via the link sent to your email from my Safar Point email Support@safar-point.com, or online through our official website Safar-point.com, or through the application, or by directly contacting customer service, either by using your credit card, debit card, or bank transfer.

If you wish to pay directly after completing your booking, the total amount will be deducted upon completing the booking process based on the currency in circulation on the site. Please make sure to activate your card and have the required amount in your bank account to complete the booking. The Safar Point discount code can only be used in case of prepayment, i.e., when opting for "Pay Now." Please refer to the "Currency Conversion" section above.

We offer you multiple payment options and more flexibility to ensure your convenience and to have a smoother booking experience than ever before, where you can book your room and complete the payment by choosing the following: either direct payment after completing the booking process through the website or the application, or payment later option. Room options that accept the "Pay Later" option will be clarified by stating, "You can pay later." The "Pay Later" option is available through the website and the application if available.

Value Added Tax (VAT) is a tax imposed on all goods and services purchased and sold by establishments. This indirect tax will be applied from January 1, 2018, to selected products and services that can be purchased through our website, in line with the law followed in the Kingdom of Saudi Arabia.

Direct taxes paid at the place of residence:
Some accommodations may impose additional taxes on the cost of your booking, such as "Resort Fees" or residence tax (if any) when using certain services. The customer is asked to pay the "Resort Fees" during their stay, and these fees are not included in the room cost displayed on the website or application, but they are clarified within the details of the accommodation.

The tax rate and types of taxes applied and their transactions vary from place to place and may change without prior notice.

Mobile Terms

By using SafarPoint mobile apps to access the SafarPoint and/or any other sister Company Services (the "Mobile Service"), you accept and agree to be bound by the terms and conditions of the SafarPoint website, herein this section, in addition to the rest of these Terms of Service. Your continued use of the Mobile Service is conditioned upon your compliance with these Mobile Terms.
By using the Mobile Service, you understand and agree that SafarPoint has no obligation to maintain, support, upgrade, or update the Mobile Service, or to provide all or any specific content through the Mobile Service. You further understand and agree that we may access, collect, and use information, which may include personally identifiable information, which your mobile device automatically makes available to our mobile app, consistent with our Privacy Policy.

Copyright and Trademarks

All content of the SafarPoint website is subject to copyright.
The website is for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the website.
The website, sister companies’ names, and any other product or trade names of SafarPoint referenced to the website are our trademarks and/or registered trademarks. Other product and company names mentioned herein may be the trademarks of their respective owners.

Package terms and conditions

Cancellation requests are accepted up to 10 days before the departure date at the latest. Cancellation policies vary from package to package, so we advise you to review the cancellation policy for each package before making your reservation through customer service prior to booking.

The amount paid for flight tickets and travel insurance for the package is non-refundable after payment and confirmation of the booking under any circumstances.

The package booking amount is non-refundable in full, in part, or not refundable based on the cancellation policy. However, the following terms generally apply based on the cancellation date:
Touristic services (hotel, transportation, tours, excursions):
•    50% of the booking value will be charged for cancellations made 10 to 14 days before the departure date.
•    The full booking value will be charged for cancellations made less than 10 days before the departure date.
•    The full booking value will be charged for no-shows or early departures.

Booking rates depend on availability at the time of booking.
You may be required to have early arrival flight times or late departure times from the hotel. Our customer service team or airlines will directly inform you of the travel times and flight schedules upon booking to prepare for your trip.

Safar Point reserves the right to modify or change the hotel to another hotel of the same category in emergency situations (booking for more than the available rooms, blackout dates).
All flights are subject to the airline's transport conditions.

Safar Point is not responsible for completing travel visa procedures for the package, and you are responsible for carrying all travel documents or any travel-related procedures.
The carriage of passengers and their baggage by air will be subject to the Conditions of Carriage of the carrier concerned.
The carriage of passengers and their baggage may also be subject to the applicable Warsaw Convention 1929 or the Montreal Convention 1999, and other applicable legislation which may limit or stipulate the carrier's liability in certain circumstances.

Hotel terms and conditions:

- Types of Accommodation:
Accommodation options on the Safar Point travel and tourism website, referred to herein as the site and/or application and/or iOS and Android smart device applications. This site and/or application has been created to assist customers in obtaining information and booking accommodations, including hotels, hotel apartments, motels, bed and breakfasts, guesthouses, and others.
- Your entry to or use of this site and/or application in any form constitutes your full acknowledgment and acceptance of all displayed prices, terms, and conditions of site and/or application use. This constitutes a direct (legally binding) agreement by Safar Point, confirming that the booking has been confirmed by the accommodation provider. The booking will be confirmed via email, which includes the payment receipt. Safar Point reserves the right not to accept bookings as outlined in the "Cancellation Policy" section below.
- Accommodation Information:
The information on the Safar Point site is sourced from various service providers and accommodation venues. While Safar Point endeavors to present the most up-to-date and accurate information, we cannot guarantee the accuracy and reliability of the information at all times, as it primarily depends on prices and room availability, which may change from time to time.
- The displayed prices include service fees and taxes. Your booking price will be detailed on the payment page. Some hotels may impose additional fees that must be paid directly upon check-in, such as city tax, tourist taxes, insurance fees, resort fees, etc., which are not included in the total booking amount. In some cases, this information may be provided on the hotel information page under the "Mandatory Fees" section.
- Accommodation Classification:
Accommodation classification follows local standards in the respective countries, which vary from country to country. This classification can be used as a guideline tool rather than an official rating. Customers should be aware that accommodation standards, even within the same category, may vary from country to country and even within the same country. Sometimes, the classification is based on the self-assessment of the accommodation. Therefore, Safar Point does not guarantee the accuracy of accommodation ratings and, to the maximum extent permitted by law, assumes no legal responsibility for any ratings displayed on the site.
- Consumption Charges:
Additional charges may sometimes be imposed directly during the stay at certain hotels. These charges may include consumed electricity, baggage transfer, provision of daily newspapers, safe deposit box, tour fees, room service charges, etc. Safar Point is not responsible for adding any of these charges, which are applicable in certain countries (such as the United States, for example). On the other hand, it should be noted that additional charges may apply for many optional services, which are not included in the total cost, such as parking fees, direct consumption from the room's minibar, phone calls from the accommodation, internet service, movies.
- During peak seasons, some accommodations may add dinner party charges to the total cost (such as New Year's Eve, Christmas, Chinese New Year, etc.), which may not be included in the room rate, and the guest must pay them directly at the hotel. In some cases, this may be mentioned in the "Mandatory Fees" section on the "Accommodation Details" page.
- Transportation Charges:
Mandatory transportation charges may apply to provide transportation services at some accommodations and are added to the total room rate based on the accommodation provider's request or the customer's request. These charges are common in areas that are difficult to access without transportation, such as islands (e.g., the Maldives, for example). Please note that Safar Point is not responsible for organizing and providing transportation services; the responsibility lies with the accommodation venue. Safar Point assumes no responsibility for the quality, availability, or safety of transportation available in the desired visiting area.

Right to cancel:

SafarPoint reserves the right not to accept customers or bookings (or to cancel confirmed bookings in extreme cases) at its own discretion and for whatever legal reason without the need to justify such refusal. Typical reasons for rejecting a customer or a booking include, but are not limited to:
•    Breach of SafarPoint’s terms and conditions
•    Accommodation closure
•    Incorrect rate
•    Force majeure events
•    Trade or economic sanctions
•    Embargoes, legal restrictions
•    Fraud or theft
•    Suspected criminal activity
•    Submission of misleading or erroneous information
•    Credit card problems
•    Inappropriate behaviour
•    Threats or insults
If a booking is rejected or cancelled by SafarPoint and a payment has already been made, the total booking value will be refunded.
We also reserve the right to bar (or “blacklist”) users from SafarPoint’s website and app, on a temporary or permanent basis, with no prior notice. Any such blacklisted users must not attempt to use the website and app under any other name or through any other user.
SafarPoint might also be forced to reject or cancel bookings due to 'obvious errors'. An obvious error is a mistake found on the website or app related to the booking prices that a customer might not consider being 'obvious'. SafarPoint is entitled to reject or cancel any booking where this error is applicable with no prior notice. In such cases, the amount charged will be reimbursed.
Please be aware that all the prices mentioned on website and app are based on the dates and number of guests requested (unless indicated otherwise). SafarPoint will typically display the rate inclusive of tax recovery and service charges (see below for more details) on the website and app, and display these additional tax recovery and service charges during the booking path.
The final amount a customer is requested to pay will be stated clearly before finalising the booking. A detailed view of the payment will be shown before the booking is confirmed. Please verify every step of your reservation on the booking form.
What is included in the rate is displayed on the website and app (under the room selection section or prior to the final booking confirmation) and/or in the confirmation email/voucher.
The standard accommodation room reservations include single, double or triple occupancy. Extra beds will usually come with extra charges unless stated otherwise. Please be sure to notify the accommodation in advance if there are additional guests because the accommodation reserves the right to reject last-minute guests.
Insurance of any kind is not included in the rates.

Indemnity & Limitation of Liability

As a condition of use of the SafarPoint website, you agree to indemnify us from and against any and all liabilities, expenses (including attorney's fees) and damages arising out of claims resulting from your use of the website, including without limitation any claims alleging facts that, if true, would constitute a breach by you of these terms and conditions.
In no event will the website be liable to you for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages (including without limitation lost business opportunities, lost revenues, or loss of anticipated profits or any other pecuniary or non-pecuniary loss or damage of any nature whatsoever) arising out of or relating to (i) this agreement, (ii) the services, the site or any reference site, or (iii) your use or inability to use the services, the site (including any and all materials) or any reference sites. In no event will the website or any of its contractors, directors, employees, agents, third-party partners, licensors or suppliers’ total liability to you for all damages, liabilities, losses, and causes of action arising out of or relating to (i) this Agreement, (ii) the Services, (iii) your use or inability to use the Services or the site (including any and all materials) or any reference sites, or (iv) any other interactions with the website, however caused and whether arising in contract, tort including negligence, warranty or otherwise, exceed the amount paid by you, if any, for using the portion of the Services or the Site giving rise to the cause of action or Ten Riyal (SAR 10), whichever is less.
Using the site constitutes agreement to all policies, terms, and conditions in both Arabic and English. In case of any conflict between the Arabic and English versions of any terms, conditions, or policies, the Arabic version shall prevail, govern, and interpret.

Waiver

The failure of the website to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by SafarPoint.
